New NOAA Alert: Hurricane Season and El Nino 2009:
            NOAA has downgraded the outlook for the 2009 Hurricane Season because of the effects of the recently formed El Nino, but warns us all not to let our guard down (NOAA News, August 6, 2009). There are other factors in play that may cause a higher number of storms or stronger storms than during previous El Nino cycles. While the outlook may have been downgraded, it important, as pointed out in this article, that late season tropical storms and hurricanes can be just as deadly as early ones. Two examples of strong hurricanes that formed during El Nino cycles are Camille in 1969 and Bob in 1991. And seasons with a late start can begin deadly as in 1992, when the first storm of the season, Andrew, formed in late-August. Anchoring Information for Florida Cruisers:

ALEXANDRIA, Va., July 30, 2009 - With the May 27th passage of Florida House Bill 1423, boaters across the state will no longer have to fear a visit from a law enforcement officer advising that their boat has "overstayed" its visit. That's because the recent legislation makes it clear that local municipalities cannot usurp state authority on regulating recreational vessel anchoring. But what's not so clear is who understands the changes, some of which came into effect on July 1 and others are due to take effect October 1, 2009.

"BoatU.S. wants to get the word out that the local restrictions on where and how long a boat may anchor are not applicable," said BoatU.S. Vice President of Government Affairs Margaret Podlich. "As of today there are no enforceable anchoring ordinances outside of the marked boundaries of mooring fields anywhere in Florida," she added. Before the passage of HB 1423, boaters sometimes had as little as 24 hours before being told by law enforcement they had to depart or fear a written citation.

In addition to working with a coalition of boating interests to pass the bill, BoatU.S. has created a new, easily downloadable two-page reference sheet, Anchoring Information for Florida Cruisers , that shares the details of the new law. "Anyone boating in Florida should have a copy aboard in case any misunderstandings arise. Law enforcement officers may also find the document helpful," added Podlich.

The free reference sheet points out four significant aspects of HB 1423:

"Live-aboard" definition: Effective July 1, the definition of a "live-aboard" vessel has been substantially narrowed. Now, cruisers who reside on and move their boats are not considered live-aboards.

Local government laws on anchoring: Effective October 1, municipalities may not enforce any ordinance regulating anchoring -- other than live-aboards -- outside of marked mooring fields.

Mooring field pilot program: In the next few years the state will work in five geographic areas to develop a mooring field pilot program to test new anchoring and mooring concepts with both live-aboard and non-live-aboard boats. While these local municipalities will be able to regulate by ordinance the anchoring of vessels outside of a pilot mooring field, it can only take effect after significant input from stakeholders and the Florida Fish and Wildlife Conservation Commission (FWC). It is expected to take several months before the first location is selected.

Boating restricted areas: As of October 1, for public safety reasons local governments will be allowed to create "boating restricted areas." The Florida Fish and Wildlife Conservation Commission and the U.S. Coast Guard may use these areas to restrict speed or boat traffic. However, there are limits on where they may be placed and they are only enforceable after a uniform waterway marker is in the water. (Laws of Florida Chapter 2009-86, section 13).

Special Notices

            Single rated Loran Stations Jupiter, FL (7980-Y), Las Cruces, NM (9610-X), and Middletown, CA, (9940-X) will be on air testing the Loran Data Channel uninterrupted until further notice.
            Dual rated Loran Stations Dana, IN (9960-Z), George (9940-W), Seneca, NY (8970-X), Gillette, WY (8290-X), and Grangeville, LA (7980-Y) will be on air testing LDC between 0800 and 1500 local time Monday through Friday.
The test broadcast will use pulse position modulation of a ninth pulse added one thousand microseconds after the standard pulse group.
            Throughout the test period the signal will meet all service performance parameters published in the 1994 specification of the Loran-C signal. Users should not experience any tracking errors or service interference from this test broadcast. Users will be notified of any changes to the test schedule and when the testing is complete.
            Loran users are encouraged to report any Loran service degradation or outages they experience via the following methods:

CASCO BAY Nav Aid Change:
The Coast Guard has established a temporary aid in (pa) 43-49-32.903N / 069-52-10.812W while Birch Point Light is reconstructed. Mariners are urged to use caution while transiting the area. (USCG 1st District LNM 31)

Submerged Vessel--Gloucester, MA:
            The Coast Guard has received a report of a submerged vessel in position 42-34.90N latitude 070-40.10W longitude. Located in vicinity of the center of the Dogbar Breakwater on the harbor side. Mariners are advised to use caution while transiting the area. (USCG 1st District LNM 31)

Boston Harbor:

Submerged Vessel--Great Kills Harbor:
            The coast guard has received a rpt of a partially submerged 18ft pleasure craft in position 40-31.7n 074-07.29w, in the vicinity of Great Kills Harbor. All vessels are requested to proceed with caution and report sightings to the U. S. Coast Guard. (USCG 1st District LNM 31)

Ambrose Channel, NY Nav Aids Change:
            The Coast Guard is considering making the following changes to Aids to Navigation to enhance navigation in this channel:
ADD ADD Tidelands Automated Information System (AIS) Informer V-03 type I transmitter.
ADD Tidelands RACON Seabeacon II version 6 transmitting RACON morse character ALPHA (.-) (dot dash).
Interested mariners are strongly encouraged to comment on this proposal in writing, either personally or through their organization. Coastal Waters from Shrewsbury River, New Jersey to Little River, South Carolina

Delaware River Nav Aid Change:
            On or about 30 September, 2009, Horseshoe Bend Range Front Light will be changed to Horseshoe Bend Directional Light visible 1.5 degrees either side of range line, lighted throughout 24 hours. (USCG 5th District LNM 31)

Baltimore Harbor—Constellation Turn-Around:
            Mariners are advised that the annual turn-around of the historic sloop-of-war U.S.S. Constellation is scheduled to occur in Baltimore Harbor, at Baltimore, Maryland on Friday, September 11, 2009, between 3 p.m. and 6 p.m. The event consists of towing the historic sloop-of-war from its Inner Harbor berth at Pier 1 to the Fort McHenry Angle, then turning the vessel around, and towing it back to its Inner Harbor berth. As described in Title 33 Code of Federal Regulations Section 165.512, a temporary moving safety zone is established during the towing operation. The moving safety zone includes all waters within 200 yards ahead of or 100 yards outboard or aft of the historic sloop of war U.S.S. Constellation while operating in the Patapsco River, Northwest Harbor and Inner Harbor. The zone will be enforced from 2 p.m. through 7 p.m. on September 11, 2009. Except for USS Constellation Turn-around Participants, no person or vessel may enter into or remain within this area. Persons or vessels requiring entry, must first request permission by the Captain of the Port Baltimore, at (410) 576-2693, or Coast Guard patrol vessels enforcing the zone on marine band radio channel 16 VHF-FM. If authorized by the Coast Guard Patrol Commander to enter or pass through the zone, persons or vessels must proceed at the minimum speed necessary to maintain a safe course while within the zone. The Coast Guard may be assisted in the patrol and enforcement of the zone by Federal, State and local agencies. No Daytime Openings at Woodrow Wilson Bridge:
            Effective July 30, 2009, mariners are advised that the Coast Guard is changing the drawbridge operation regulations of the new Woodrow Wilson Memorial (I-95) Bridge, at mile 103.5, across Potomac River, between Alexandria, VA, and Oxon Hill, MD. Currently, Title 33 Code of Federal Regulations Part 117.255(a) (2) (i) states (paraphrasing) that the drawbridge need not open for the passage of a commercial vessel, Monday through Friday (except Federal holidays), from 5 a.m. to 10 a.m. and from 2 p.m. to 8 p.m. and this final rule connects the two time periods by extending the operating regulation to cover the entire period from 5 a.m. until 8 p.m. This rule is being made in an effort to minimize the potential for major regional vehicular traffic impacts and consequences during bridge openings of the draw span while still providing for the reasonable needs of marine traffic. Dredging in Hampton Roads:
            The Dredge LEXINGTON will be conducting dredging operations in the vicinity of Piers 2-14 Naval Base Norfolk from 23 June until 23 September, 2009. The dredge will monitor VHF-FM Channels 13 and 16.
The dredge MOBRO 112 will be conducting dredging operations along the West yard bulkhead out to the channel at Colonna’s Shipyard, along the Eastern Branch of the Elizabeth River. Dredging operations will be conducted from 23 July to 23 September, 2009. The dredge can be contacted on VHF-FM Channels 13 and 16. Mariners are requested to review the dredging and mariner construction cautions notice at the beginning of this section. (USCG Fifth District LNM 31)

Bridge Demolition, DC Area:
            Mariners are advised to take caution when approaching the George Washington Memorial Parkway Bridge (Humpback bridge) over Boundary Channel, Mile 0.0, to Columbia Island in Arlington, Virginia. Partial demolition of the bridge will be conducted from August 17 to August 27, 2009, at night from 7 p.m. to 5 a.m. The waterway shall remain open to navigation with minimal delays. Please follow construction flagmen directions. As the construction schedule progresses, please check these resources frequently for potential navigational impacts. (USCG 5th District LNM 31)

Rudee Inlet, Again:
            The City of Virginia Beach survey of Rudee Inlet indicates shoaling to a depth of 8.0 and 9.0 feet MLLW approximately 200 feet east of the north jetty on the inbound and outbound sides of the channel. Shoaling continues westward for approximately 100 feet on the north jetty and west of the south jetty for approximately 150 feet. Mariners are encouraged to exercise extreme caution when transiting this area. (USCG 5th District LNM 31) NOTE: The City of Virginia Beach surveys this inlet on a monthly basis and the reports appear in the Local Notices to Mariners often. We report each new survey. There is dredging constantly in this inlet to keep it open and the results have been reported as good recently. Keep in mind that any dredged inlet (or any inlet, for that matter) can change in depth with any passing storm and that these should be entered with caution, especially by those who are unfamiliar with the area and may not be privy to local knowledge. York River (Naval Weapons Station) Dredging:
            The Dredge VIRGININA will be conducting dredging operations in the York River at pier R-3 Yorktown Naval Weapons Station from 30 July until 20 September, 2009. The dredge may be contacted on VHF-FM channels 13 and 16. (USCG 5th District LNM 31)

Navy Small Arms Exercise, James River, VA:
            The Coast Guard is establishing a temporary safety zone is in support of the U.S. Navy small arms gunnery exercises and explosive training events on the M/V DELMONTE. The safety zone will restrict vessel traffic on the James River within 1500 foot radius of position 37-06-11N, 076-38-40W and will be in effect between 8:00 a.m. and 11:00 p.m. from 30 July until 08 August, 2009. Oregon Inlet Dredging:
            The Dredge ALASKA will be conducting dredging operations at Oregon Inlet and Ocean Bar from 28 July until 20 November, 2009. A floating and submerged pipeline will transport the spoil to the Pea Island beach. The tugs LONE STAR, PELICAN STATE and GULF DAWN and the crew boat COOPER RIVER will be onscene assisting. The dredge and tugs may be contacted on VHF-FM channels 13 and 16. (USCG 5th District LNM 31)

Shoaling, Oregon Inlet Channel:
            Shoaling to a depth of 2.0 feet MLW has been reported between the north fender system of the Bonner Bridge and Oregon Inlet Buoy 14 and extending approximately 75 feet into the channel. Mariners should avoid transiting this area during periods of low water and exercise caution during other tidal periods. (USCG 5th District LNM 31)

Sunken Vessel--NC Coast:
            The F/V TINA RAE has sunk in approximate position 35-13.12N, 075-20.39W, approximately 9.3NMs east of Cape Point in approximately 58 feet of water. Mariners should use extreme caution when transiting the area. (USCG 5th District LNM 31)

Dredging: Lockwoods Folly Inlet (Not on the ICW):
            The Dredge Merritt will commence dredging Lockwoods Folly Inlet commencing 25 July, 2009 until completion. (USCG 5th District LNM 31)

USCG Seventh District
Coastal Waters from Little River, South Carolina to Panama City, Florida

ICW Shoaling, North of Charleston:
            Shoaling has been reported in the vicinity of Winyah Bay-Charleston Harbor Daybeacon 84. A 6th class temporary buoy has been deployed channelward of assigned position in approximate position 32-54-23.500N 079-40-24.700W to mark best water. All mariners are advised to transit the area with caution. (Seventh District LNM 31)

Dredging in Charleston Harbor:
            Atlantic Dredging, LLC, has advised that staging and preparation for dredging activities will commence on or about 22 July 2009 in the vicinity of Charleston Naval Base Container Terminal on the Cooper River, Charleston, South Carolina. Dredging will be performed on the west side of Daniel Island Reach approximately 1000 feet off the shoreline. Pipelines will run submerged from the project site approximately 32 deg 50.267N 079 deg 55.920W across the Cooper River to the Daniel Island Containment Facility to Daniels Island at approximate position 32 deg 49.541N 079 deg 55.500W. The dredge TRENTON with M/V POOLES ISLAND and booster barge PB-1 will be on-scene and monitor VFH Channel 13. In mid August the dredge TANGIER SOUND with larger pipelines will be on-scene to commence dredging on or about 1 September 2009. The project will continue on twenty-four (24) hours a day seven (7) days a week basis until completion on or about 31 March, 2010. Charleston Harbor Marina, Dredging:
            Salmons Dredging Corporation has commence maintenance dredging/excavation at the Charleston Harbor Marina in Mount Pleasant, South Carolina. A clamshell dredge, tug and barge will be on-scene and the dredge spoils will be transported to Salmons Dredging Corporations facility on the Shipyard River. This project will be completed on or about August 8, 2009. The tug will monitor VHF Channel 13 and 16. All vessels transiting this area are requested to operate their vessels at their slowest safe speed. 65-Year-Old Bombs Discovered in Charleston Harbor:
            The U.S. Navy during environmental assessments at the Charleston Naval Air Station (NAS), Charleston, SC, on the Cooper River discovered at two (2) locations identified as AOC 500 and AOC 502, that two (2) AN Mark 47 Torpex bombs were dropped at location AOC 500 and three (3) unexploded 5” shells were dropped at location AOC 502. The shells are at 40’ below Mean Low Water (MLW), and were dropped September 1944 and January 1945. Due to depth of the water no charting action will take place. To review background information and overhead charting of the area please see Enclosure Number 9 of the LNM (LNM 29). Stono River (ICW) Range Change Proposal:
            The following changes have been proposed for the aids to navigation system in the Stono River.
            Change STONO RIVER RANGE C FRONT LIGHT to Light 28 displaying Quick Flash Red and TRs on a pile.
            Permanently discontinue STONO RIVER RANGE C REAR LIGHT.
            Renumber STONO RIVER DAYBEACON 28 to Daybeacon 28A.

Dredging: Canaveral Harbor:
            Misener Marine Construction, Inc., will commence clamshell dredging operations on or about August 11, 2009, in the West Turning Basin, Cruise Terminal #8, at Port Canaveral, Canaveral Harbor, Florida. Equipment on scene will include one (1) 150’x50’x9’barge (IBE-2701-1) with crane, one material barge (M-1501) and one (1) tug SEA-DOZER II. This operation will be daily from 7:00 a.m. to 6:30 p.m. Mondays through Wednesday and Fridays only. Dredging and/or transferring of spoil material to off-load site will not affect the channel or main waterway, no navigation aids are located within the extent of this project. The tug SEA-DOZER II will monitor VHF Channels 13 and 16. This project will be completed on or about September 30, 2009. For further information please contact Mr. Daniel Schroeder at (321) 783-9442. More Shoaling in St. Lucie Area:
            All mariners are advised of continuous shoaling in the St Lucie Inlet, St Lucie River, and St Lucie Canal. Additional shoaling has also been reported west of the crossroads (ICW) in St Lucie on the north side of the channel, (Shoaling extends the entire width of the Channel).
            St Lucie Inlet: Between St Lucie Inlet Buoy 6 and St Lucie Inlet Lighted Buoy 7
            St Lucie River: Between St Lucie River Inlet Daybeacon 6 and St Lucie River Inlet Daybeacon 8
            St Lucie Canal: In the vicinity of St Lucie Canal Daybeacon 38
Mariners are urged to transit areas affected with extreme caution and general knowledge. (Seventh District LNM 31)
Summer Lock Closures for Maintenance in Okeechobee Waterway:
            It is not now possible to use the Okeechobee Waterway to cross from one side of Florida to the other, as the Moore Haven Lock closed for major maintenance on June 8 and will not open again till September 3, 2009. The W.P. Franklin Lock is now also closed as of July 6, for installation of a Manatee Protection System and will reopen on August 26, 2009. (USACE Jacksonville)
            And now that the lake route is not available for crossing the Florida peninsula, the level is finally up to an adequate depth for most boats for that purpose. On August 5, 2009 the Lake Level was 13.65 feet. You can check the daily lake level at http://w3.saj.usace.army.mil/h2o/reports/r-oke.html.

Florida Bridge Update: From the USCG 7th District LNM 31:           
            BB McCormick Bridge, Mile 747.5: There will be work on the fender system of the new bridge until October, 2009. The channel may be restricted by a barge which can be moved to accommodate larger vessels.         
            Bridge of Lions, Mile 777.9: See schedule above.
            Max Brewer Bridge, Mile 878.9: AKA Titusville Bridge, will be replaced with a high level bridge. Construction began May 11, 2009 and will continue through April, 2011. Starting July 23 at 8:00 a.m. and continuing through 5:00 p.m. August 14, 2009: The east channel of the swing bridge will be closed to facilitate construction of the new bridge. Coast Guard Sector Jacksonville will broadcast Notices to Mariners regarding restrictions as needed.
            Bakers Haulover Bridge, North Miami Beach (Not on the ICW): The fender system on this bridge will be replaced between April 12 and December 7, 2009.A barge and floating equipment will be in the vicinity and at times will be restricting the navigable channel.
            5th Street Bridge, Miami River, Mile 1.5 (Not on the ICW): During continued construction of the new bridge, there will be two 72 hour closure periods. The first will begin on August 17 and the second will begin on Sept. 14, 2009. The contractor is making plans to allow small boats to pass.
            Big Marco Pass Bridge, Marco Island: Painting until September 30, 2009 will reduce vertical clearance by three feet.
            US 41 Bridge, Ft. Myers: Painting until September 30, 2009 will reduce vertical clearance by three feet.
