BoatUS “Wave Of Fortune” Sweepstakes Official Rules

No Purchase Necessary to play or to win a prize.

1. HOW IT WORKS: From January 1, 2009 through November 30, 2009, (the “Sweepstakes Period”), those commercial, retail and service entities with whom Sponsor has contracted (“Sponsor’s Designees”) shall allocate game plays to both current BoatU.S. members and the general public through whatever legal means and in whatever legal manner they choose in their sole discretion such that said BoatU.S. members and the general public may enter for a chance to win the prizes specified below. Note: Contest entry period for anyone who joins, renews, sponsors or purchases a gift membership to BoatU.S. per contest rule #4 (below) runs December 1, 2008 through November 30, 2009. Contest entry period for anyone who plays DockIt! or submits an alternate method of entry as per contest rule #4 (below) runs January 1, 2009 through November 30, 2009.

2. ELIGIBILITY: Open to legal U.S. and Canadian residents (excluding Quebec) who are 18 years of age or older at time of entry. Void where prohibited by law. Employees of Sponsor, its parents, affiliates and subsidiaries, participating advertising and promotion agencies and prize suppliers (and members of their immediate family and/or those living in the same of household of each) are not eligible.

3. HOW TO PLAY: During the Sweepstakes Period an eligible contestant may receive a game play pursuant to paragraph 1 above. The contestant may then visit Sponsor’s website at www.BoatUS.com and participate in the “Wave of Fortune” Sweepstakes as described or directed.

Players may participate in the sweepstakes by 1) joining BoatU.S. Membership 2) renewing BoatU.S. Membership 3) sponsoring a new BoatU.S. Member 4) purchasing a BoatU.S. Gift Membership 5) Playing and completing designated levels of BoatU.S. DockIt! and 6) submitting a postcard as an alternate method of entry (see 4. TO OBTAIN A GAME PLAY WITHOUT PURCHASE).

By joining BoatU.S. Membership, renewing a BoatU.S. Membership, sponsoring a new BoatU.S. Member, or purchasing a BoatU.S. Gift membership, the purchaser and sponsor (if applicable) will receive an automatic entry into the contest for the month in which the transaction occurred. All entries via these methods will also be entered into the final grand prize drawing at the end of the sweepstakes period. These entries are automatic and the purchaser and sponsor (if applicable) need not take any action to enter the sweepstakes. Entry into the sweepstakes via methods 1-4 will be provided directly to SCA via file transfer for inclusion.

Interested parties may also enter the sweepstakes by playing and completing designated levels of the member’s only ten-level DockIt! game, an online game found at the official BoatUS Games website at www.boatus.com/games. The contestant will then be prompted to enter the requested demographic information, and upon pressing “Submit”, the contestant will instantly receive a message (“Screen Shot”) notifying the contestant whether or not he/she is a weekly prize winner. The method for selecting the weekly prize winner is done via a random date/time generator for the designated week. Each game play is eligible for only one (1) play attempt. Each player is eligible for up to ten entries a day via the member’s only ten-level DockIt! Game,found at the official BoatUS Games website at www.boatus.com/games . If a winning message (i.e., Screen Shot stating that the contestant is a weekly prize winner) is received in response to the designated game play, said contestant is a potential winner of the prize specified herein, subject to contestant eligibility. A confirmation e-mail will be sent to the winning contestant at the e-mail address provided by contestant during the log in process.

Any player is eligible to win one and only one prize in each category. All eligible entries, regardless of method of entry, will be qualified for both the Monthly Prize, to be awarded using a random selection process on the final day of each month, and the Grand Prize, to be awarded using a random selection process at the conclusion of the sweepstakes. The winner selection process for both the Monthly Prizes and Grand Prizes will be done in a random and auditable manner. All sponsor decisions pertaining to all winner selections are binding and final. All potential winners are subject to verification of eligibility and compliance with the sweepstakes rules before any prize will be awarded. Potential Canadian winners will also be required to correctly answer a time-limited mathematical skill testing question without aid, mechanical or otherwise, prior to being confirmed a winner. All taxes on any prize are the sole responsibility of the winner.

4. TO OBTAIN A GAME PLAY WITHOUT PURCHASE: During the Sweepstakes Period, an individual may obtain a free game play by mail by mailing a postcard with proper postage to: “BoatUS. Wave of Fortune Sweepstakes,” c/o SCA Interactive, ex. L.L.C., 8300 Douglas Avenue, Ste 645, Dallas, Texas 75225. The postcard must include the player’s name, address, email address, and daytime phone number. Limit one (1) entry request via postcard per household per day will be accepted. Each request must be made on separate postcards. Requests must be postmarked by November 1, 2009.

5. CONDITIONS OF PARTICIPATION: If due to printing, production or other errors, more prizes are claimed than intended, the intended prize will be awarded in a random drawing from all those submitting purportedly valid claims. No more than the number of prizes set forth in these Official Rules will be awarded. Game plays not legitimately obtained and/or used in accordance with these rules are void. Use of any automated system to participate is prohibited and will result in disqualification. ALL POTENTIAL WINNING PLAYS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING. A “SCREEN SHOT” IS NOT PROOF OR EVIDENCE OF A WINNING GAME PLAY AND/OR PRIZE. A CONTESTANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE INSTANT WIN GAME SHOULD SO INDICATE, UNLESS AND UNTIL SAID CONTESTANT’S ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAS BEEN VERIFIED AND SAID CONTESTANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED. No transfer, assignment or substitution of a prize will be permitted, except Sponsor reserves the right to substitute prize for an item of equal or greater value in the event an advertised prize is unavailable. All federal, state and local laws and regulations apply. Contestants agree to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this sweepstakes. Confirmation e-mails returned as undeliverable may result in disqualification. Acceptance of a prize constitutes permission for Sponsor and its agencies to use winner’s name and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by law. By accepting prize, winners agree to hold Sponsor, Sponsor’s Designees, their respective directors, officers, employees, assigns, and advertising and promotional agencies harmless for any injury or damage caused or claimed to be caused by participation in the Promotion. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the sweepstakes or in the announcement of the prize.

6. PRIZES AND APPROXIMATE RETAIL VALUES: One (1) and only one Grand Prize of $25,000 is available to be won. Odds of winning the Grand Prize depend upon the total number of eligible entries. The Grand Prize will be paid in the form of a check, which shall be sent to the verified winner via certified U.S. mail within five business days of verification of the win and winner’s eligibility. The scheduled draw date for Grand Prize is 12/1/2009 and the anticipation date of the final determination and verification of Grand Prize winner is 12/21/2009. Winner are responsible for any/all local, state and federal taxes. Unclaimed prizes will not be awarded.

MONTHLY PRIZES: Eleven (11) Monthly Prizes with a total value of $4,000 are available to be won. Odds of winning the Monthly Prizes depend upon the total number of eligible entries. The Monthly Prizes will be distributed in the form approved by the sponsor and distributed directly to the verified winner via certified U.S. mail or other package carrier within 15 business day of verification of the win and winner’s eligibility. Winners are responsible for any/all local, state and federal taxes. Unclaimed prizes will not be awarded. A full listing of the Monthly Prizes is included.

7. INDEMNIFICATION. By participating, contestants agree to release, discharge, indemnify and hold harmless Sponsor, Sponsor’s Designees, and each of their respective officers, directors, employees, representatives, agents, advertising and promotional agencies from and against any claims made by winners, entrants, or any other third parties, related in any way to the operation of this sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any sweepstakes-related activity or participation in this sweepstakes.

8. INTERNET: In the event of a dispute as to any registration or play, the authorized account holder of the email account used to log in to the sweepstakes website will be deemed to be the registrant or player. The "authorized account holder" is the natural person assigned an email account by a service provider or other entity responsible for assigning email accounts for the service. Potential winners may be required to show proof of being the authorized account holder. Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive information by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes, technological or otherwise, which corrupt, disrupt or otherwise affect the administration, security, fairness, integrity, or proper conduct of this sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend any and all aspects of the sweepstakes. Sponsor reserves the right, but not the obligation, to randomly select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process. Caution: Any attempt by any individual to deliberately damage any Web site or undermine the legitimate operation of the sweepstakes is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such individual to the fullest extent of the law.

9. GOVERNING LAW; DISPUTES: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of Texas or the appropriate Texas State Court located in Dallas County, Texas; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this sweepstakes but in no event attorneys’ fees; and (iii) under no circumstances will a participant be permitted to obtain awards for and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be construed and governed by the laws of the State of Texas, without regard to conflicts of law rules.

10. WINNER'S LIST: Any legally required list of winners may be obtained by sending an email with Subject Line: “The BoatU.S. “Wave Of Fortune” Sweepstakes Winner List Request,” to WinnerListRequests@scapromo.com. All such requests must be received within six (6) weeks after the end of the Promotion Period.
